KwikFastHurry, Inc. respects intellectual property rights and expects everyone on the Platform to do the same. This Policy explains how to report infringement and how we respond.
#1. Our designated agent
Send copyright notices to our designated agent under the Digital Millennium Copyright Act:
Copyright Agent — KwikFastHurry, Inc. 1 Market Street, Suite 500, Wilmington, DE 19801, USA Email: dmca@kwikfasthurry.com Phone: +1 (888) 555-0123
Our agent is also registered with the US Copyright Office. Notices sent to any other address may not be actioned.
#2. How to send a takedown notice
To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- A physical or electronic signature of the copyright owner or someone authorised to act for them.
- Identification of the copyrighted work you say has been infringed. If several works are covered by one notice, a representative list.
- Identification of the infringing material and enough information for us to locate it — a direct URL, a store name, a menu item, a review, or a screenshot with context.
- Your contact details: name, postal address, telephone number and email address.
- A statement that you have a good faith belief the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on the owner's behalf.
Send it by email to dmca@kwikfasthurry.com with the subject line "DMCA Takedown Notice", or by post to the address above.
Consider fair use first. Submitting a notice about material that is a fair use, or that you do not hold rights in, can make you liable under 17 U.S.C. § 512(f) for damages and costs, including the other party's legal fees. If you are unsure, take advice before sending.
#3. What we do with a notice
- We acknowledge receipt, normally within 2 business days.
- If the notice is complete, we remove or disable access to the material expeditiously.
- We notify the user who posted it and give them a copy of the notice, including your name and contact details.
- We record a strike against that user's account.
- If the notice is incomplete, we tell you what is missing so you can resubmit.
#4. Counter-notice
If your content was removed and you believe that was a mistake or a misidentification, you may send a counter-notice under 17 U.S.C. § 512(g)(3) containing:
- Your physical or electronic signature.
- Identification of the removed material and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the district where you live — or, if you are outside the United States, of any district in which KwikFastHurry, Inc. may be found — and that you will accept service of process from the party who filed the original notice or their agent.
Send it to dmca@kwikfasthurry.com with the subject line "DMCA Counter-Notice".
What happens next: we forward your counter-notice to the original complainant. If they do not tell us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the material.
Your counter-notice, including your contact details, will be given to the complainant.
#5. Repeat infringer policy
In line with 17 U.S.C. § 512(i), we terminate the accounts of repeat infringers in appropriate circumstances.
| Strikes | Consequence |
|---|---|
| First | Content removed, written warning |
| Second | Content removed, temporary restriction on posting content |
| Third | Account permanently terminated |
A strike is withdrawn if the notice is retracted, if a counter-notice succeeds, or automatically after 12 months without further strikes.
#6. Trade marks
To report misuse of a trade mark — for example a store name or logo that impersonates your brand — email legal@kwikfasthurry.com with the subject line "Trade Mark Complaint", including:
- your mark, and the registration number and jurisdiction if registered;
- proof of ownership or authority to act;
- where the misuse appears on the Platform;
- an explanation of why the use is likely to confuse consumers.
Descriptive or nominative fair use of a mark — for example a store accurately listing the brands it stocks — is not infringement and we will not remove it on that basis alone.
