KwikFastHurry, Inc. screens every Rider applicant, and re-screens active Riders periodically, to protect Customers, Vendors and the public. This page is the standalone disclosure required by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.
#1. Disclosure
KwikFastHurry, Inc. may obtain one or more consumer reports or investigative consumer reports about you from a consumer reporting agency, for the purpose of determining your eligibility to use the KwikFastHurry Rider app.
This disclosure is made in a document that consists solely of the disclosure, as the FCRA requires. Your written authorisation is collected separately in the Rider app before any report is obtained.
#2. Who prepares the report
Reports are prepared by an independent third-party consumer reporting agency (CRA). The current agency's name, address and telephone number are shown to you in the Rider app at the point you give authorisation, and are available at any time from riders@kwikfasthurry.com.
The CRA — not KwikFastHurry — collects the underlying records. KwikFastHurry makes the eligibility decision.
#3. What is checked
| Check | What it covers |
|---|---|
| Identity verification | Confirming you are who you say you are, using your government identification |
| Right to work | Your legal authorisation to work in the jurisdiction |
| Motor vehicle record | Licence status and validity, and driving history, where you deliver by motor vehicle |
| Criminal records | County, state, federal and national database searches, and sex offender registry |
| Ongoing monitoring | Where you consent to it, continuous or periodic re-checking of the above for as long as you are active |
We do not obtain a credit report, and we do not check your credit score.
#4. Investigative consumer reports
Some reports may be investigative consumer reports, which can include information about your character, general reputation, personal characteristics or mode of living obtained through personal interviews with sources such as neighbours, friends or associates.
You have the right to request, in writing, a complete and accurate disclosure of the nature and scope of any such investigation. Write to riders@kwikfasthurry.com and we will respond within 5 days of receiving your request.
#5. Your rights under the FCRA
Before any report is obtained you will receive:
- this disclosure, in a standalone document;
- A Summary of Your Rights Under the Fair Credit Reporting Act, prepared by the Consumer Financial Protection Bureau;
- any additional state-specific notices that apply where you live — including, in California, the right to request a free copy of any report obtained about you, and in New York, Minnesota, Oklahoma, Washington and other states, further disclosures which the app presents to you.
You may also request a copy of your report from us at no charge by checking the box in the app, or at any time by emailing riders@kwikfasthurry.com.
#6. If something in your report may disqualify you
We follow the two-step adverse action procedure required by 15 U.S.C. § 1681b(b)(3).
#Step 1 — Pre-adverse action notice
If a report contains information that may lead us to decline or deactivate you, before we make a final decision we will send you:
- a written pre-adverse action notice;
- a copy of the consumer report we relied on;
- a copy of A Summary of Your Rights Under the FCRA;
- contact details for the CRA that prepared the report.
#Step 2 — Your window to respond
You then have at least five (5) business days, and longer where state law requires, to:
- dispute the accuracy or completeness of the report directly with the CRA, which must reinvestigate free of charge, normally within 30 days;
- provide evidence of an error — for example a record that was expunged, sealed, or belongs to someone else;
- provide context or evidence of rehabilitation for us to consider.
Tell us you are disputing by emailing riders@kwikfasthurry.com with the subject line "Background Check Dispute", and we will hold the decision open while the CRA reinvestigates.
#Step 3 — Adverse action notice
If, after that window, we still decide to decline or deactivate you, we will send a final adverse action notice stating the decision, identifying the CRA, confirming that the CRA did not make the decision and cannot explain it, and restating your right to obtain a free copy of the report within 60 days and to dispute its accuracy.
#7. Individualised assessment
A criminal record does not automatically disqualify you. Where a record appears, we assess it individually, considering:
- the nature and gravity of the offence;
- the time elapsed since the offence or the completion of any sentence;
- the relationship of the offence to the work of delivering goods to people's homes;
- evidence of rehabilitation and anything else you tell us.
We comply with applicable "ban the box" and fair chance laws, which in many jurisdictions restrict when we may ask about or consider criminal history. Where such a law applies, we follow it.
#8. Ongoing checks
If you consent, we re-run motor vehicle and criminal checks periodically or continuously while your account is active. If a new record appears, the same pre-adverse and adverse action procedure in Section 6 applies before any deactivation.
You may withdraw consent to ongoing checks, but you will not be able to continue delivering, because current screening is a condition of eligibility under Section 2 of the Rider Agreement.
#9. How we handle the results
- Results are stored separately from your main profile, encrypted, with access restricted to a small trained eligibility team, and every access is logged.
- Results are used only to determine eligibility.
- Results are never shared with Customers, Vendors or other Riders.
- Results are retained while you are active and for 2 years afterwards, or longer where a law or an open dispute requires it.
- Full detail is in the Rider Privacy Notice.
