This Agreement is between KwikFastHurry, Inc. ("KwikFastHurry") and you, the individual who registers to make deliveries using the KwikFastHurry Rider app ("Rider", "you"). It adds to the Platform Terms of Service and controls over them where the two conflict for Riders.
#1. You are an independent contractor
You are an independent contractor, not an employee of KwikFastHurry. This is the foundation of the whole Agreement, and it is real, not a label:
- You decide whether to work. There is no minimum number of hours, no shift you must take, and no penalty for not going online. You may be offline for any length of time without notice.
- You decide which deliveries to accept. You may decline any offer. We do not require an acceptance rate.
- You decide how to do the work. Route, order of stops within an offer, and method are yours, subject to law and to the safety rules in Section 8.
- You may work for anyone else, including our direct competitors, at the same time. There is no exclusivity and no non-compete.
- You provide your own equipment — vehicle, phone, data plan, insurance and any delivery bag.
- You are responsible for your own taxes, including self-employment tax, and for your own business expenses.
Consequently, you are not entitled to employee benefits from KwikFastHurry — no wages, overtime, paid leave, health insurance, pension, or unemployment or workers' compensation coverage from us — except where a law that cannot be contracted around provides otherwise.
If a court, agency or applicable statute reclassifies your status in a particular jurisdiction, we will comply with that law, and the rest of this Agreement continues to apply so far as it is consistent with it.
#2. Eligibility
To deliver you must at all times:
- be at least 18 years old;
- hold the legal right to work in the jurisdiction where you deliver;
- hold a valid driving licence appropriate to your vehicle, where the vehicle requires one;
- hold current vehicle registration and the insurance required by Section 7;
- pass and continue to satisfy our background screening — see the Background Check Disclosure;
- own a smartphone capable of running the current Rider app;
- comply with any local licensing or permit requirement for delivery work.
Tell us within 3 days if any of this stops being true. Delivering without valid insurance or a valid licence is a material breach.
#3. How you get offers
When you go online, the app may offer you deliveries. Each offer shows, before you accept:
- the estimated total pay, including the guaranteed base;
- the pick-up and approximate drop-off locations;
- the estimated distance and time;
- whether the order requires age verification or in-person handover.
You may accept or decline. Declining does not penalise you — it does not reduce your future offers, your pay rate, or your standing. You may go offline at any time, including immediately after declining.
Once you accept, you commit to completing that delivery unless it becomes unsafe or impossible. If you cannot complete it, tell us through the app immediately so we can reassign it.
#4. Pay
#4.1 What you earn
| Component | How it is calculated |
|---|---|
| Base pay | Distance, estimated time, and the effort involved — stairs, waiting, multi-stop |
| Promotions | Peak-hour multipliers, bonuses and challenges, published in the app before they apply |
| Tips | 100% yours. KwikFastHurry takes nothing from a tip |
| Adjustments | Compensation for excessive waiting, cancelled orders after collection, and errors on our side |
The pay shown on an offer is the guaranteed minimum for that delivery, excluding tips. If the delivery takes longer or goes further than estimated, you earn more, never less.
#4.2 When you are paid
Earnings are transferred to your registered bank account on a weekly cycle by default, with instant-payout options where available and a fee that is disclosed before you use it. Every payment is itemised in Earnings in the app.
#4.3 Deductions
We deduct only: amounts you have expressly authorised; overpayments made in error, after notifying you; and amounts recoverable for proven fraud. We do not deduct the cost of an order that a Customer disputes unless we establish that you took, tampered with, or falsified the delivery.
Query any statement within 30 days.
#5. Expenses
You bear your own costs — fuel or charging, vehicle maintenance and repair, insurance, phone and data, parking and tolls, and any licence or permit fee. KwikFastHurry does not reimburse expenses. Keep your records; many of these may be deductible against your income, and you should take your own tax advice.
#6. Taxes
You are responsible for reporting and paying all taxes on your earnings. We do not withhold tax. We issue the information returns required by law based on the details you provide, so keep your taxpayer identification and address current in the app. KwikFastHurry does not provide tax advice.
#7. Insurance
You must maintain, at your own cost and at all times while delivering:
- the minimum vehicle liability insurance required by law in your state, at not less than the statutory minimum;
- cover that permits commercial or delivery use — many personal auto policies exclude it, and you should confirm this with your insurer in writing;
- any cover your vehicle type separately requires.
Provide proof on request and within 5 days of renewal. Driving without valid cover is a material breach and will result in immediate deactivation.
Where KwikFastHurry maintains contingent commercial cover that applies during an active delivery, its scope, limits and excess are published in the Rider app. It is contingent — it sits behind your own policy, not in place of it.
#8. Safety
You must:
- never use the app while driving — pull over safely and stop first;
- obey all traffic, parking, licensing and food-handling laws;
- never deliver while impaired by alcohol, drugs, or medication that affects your ability to drive;
- wear a helmet where you ride a bicycle, e-bike, scooter or motorcycle;
- keep orders sealed, upright and at the right temperature, in an appropriate insulated bag;
- never open, consume, tamper with or substitute any part of an order;
- verify age at handover where the order requires it, and refuse handover where identification is missing, altered or does not match — you will never be penalised for a good-faith refusal;
- stop and report if you are involved in an accident, and contact emergency services where anyone is hurt.
You may decline or abandon any delivery you reasonably believe is unsafe. Report it in the app; it will not count against you.
The Rider app includes in-app emergency assistance, incident reporting, and accident reporting. Report any accident or safety incident to safety@kwikfasthurry.com within 24 hours.
#9. Your conduct
You must comply with the Acceptable Use Policy. In particular you must not: share or sell your account, or let anyone else deliver on it; falsify a delivery, a location or a completion photograph; use GPS spoofing or automation tools; harass, threaten or discriminate against any Customer, Vendor or member of the public; or contact a Customer after a delivery has completed.
#10. Your account
Your account is personal to you. Account sharing is a serious breach — it defeats background screening and puts Customers at risk — and results in permanent deactivation.
Keep your profile photo current, since Customers use it to identify you at handover.
#11. Data and privacy
The Rider Privacy Notice explains what we collect, and in particular that location is collected only while you are online and on shift, with a persistent notification while it is active.
Customer information you receive is provided only to complete that delivery. Do not save it, photograph it, share it, or use it for any other purpose. Access to the delivery address is removed from your app once the delivery completes.
#12. Equipment and brand
Any KwikFastHurry branded bag or kit we supply or sell to you must be kept clean and in good condition, and used only for KwikFastHurry deliveries while you are on shift. You may state that you deliver with KwikFastHurry. You may not present yourself as an employee or agent of KwikFastHurry, or use our marks in your own business name.
#13. Deactivation
#13.1 By you
Stop at any time. To close your account permanently, see Account & Data Deletion. We will settle outstanding earnings on the normal cycle.
#13.2 By us
We may deactivate your account where:
- your licence, insurance, registration or right to work lapses;
- background screening returns a disqualifying result — subject to the process in the Background Check Disclosure;
- there is a serious safety incident or a credible allegation of violence, harassment, discrimination or impairment;
- we establish fraud — falsified deliveries, GPS spoofing, account sharing, promotion abuse;
- you tamper with or steal an order;
- you materially breach this Agreement or the Acceptable Use Policy.
#13.3 Notice, review and appeal
- Except where there is an immediate safety or fraud risk, we give you written notice of the reason and an opportunity to respond before deactivating.
- Where we deactivate immediately for safety, we tell you the reason as soon as we can and you may respond then.
- Every permanent deactivation is reviewed by a person, not by an algorithm alone.
- You may appeal within 30 days to riders@kwikfasthurry.com with the subject line "Deactivation Appeal", attaching anything that supports your case. A reviewer not involved in the original decision will assess it and respond within 14 days.
- All earnings you have already accrued are paid to you regardless of deactivation, except amounts established as fraudulent.
Low acceptance rates, declining offers, and going offline are never grounds for deactivation.
#14. Liability
You are responsible for your own acts and omissions while delivering, including your driving.
KwikFastHurry's total aggregate liability to you in any twelve-month period is limited to the total amount we paid you in the three (3) months before the event giving rise to the claim. Neither party is liable for indirect or consequential loss. These limits do not apply to liability that cannot be limited by law, or to a party's fraud.
You indemnify KwikFastHurry, Inc. against claims arising from your breach of this Agreement, your violation of law, or your negligent or intentional acts, except to the extent caused by KwikFastHurry's own fault.
#15. Disputes
Sections 16 and 17 of the Platform Terms of Service apply, including binding individual arbitration, the class action waiver, and your 30-day right to opt out of arbitration by emailing legal@kwikfasthurry.com. Opting out will not affect your ability to deliver, your offers, or your pay in any way.
#16. Changes
We may update this Agreement on 15 days' notice by email and in-app. Where a change materially reduces your pay or expands your obligations, we will give 30 days' notice. Continuing to accept deliveries after the effective date means you accept the change. If you do not accept it, stop delivering and close your account — you will still be paid everything you have earned.
